Democratic candidate for governor surprised to find she's not running because of a bounced check

AUSTIN — Demetria Smith had hoped to run for governor in 2018, but the Texas secretary of state website now lists her as ineligible.

Smith paid the $3,750 candidate filing fee with a check, but Texas Democratic Party primary director Glen Maxey said Tuesday that it had bounced, according to the San Angelo Standard-Times. The Texas secretary of state requires gubernatorial hopefuls to either pay the fee or garner 5,000 signatures on a petition when filing to run.

Her ineligibility was determined after she participated in a forum Monday in San Angelo for candidates in the Democratic primary, the Standard-Times also reported. Maxey told the paper that Smith filed on the last day allowed, Dec. 11, but the party didn’t receive notice of insufficient funds until Monday.

Smith told the Standard-Times that she was not notified of her ineligibility until Tuesday and that she would be “challenging the constitutionality” of the Texas Democratic Party’s decision.
