The Texas Supreme Court on Wednesday rejected a bid by leading state Republicans to overturn Gov. Greg Abbott’s order that added six days of early voting as a pandemic safety measure.
Early voting will begin, as planned, on Tuesday.
The GOP leaders, including Agriculture Commissioner Sid Miller and state Republican Party Chairman Allen West, argued that Abbott — also a Republican — lacked the authority to issue the order, which also lets voters hand deliver mail-in ballots before Election Day.
In a 7-1 ruing, the Supreme Court said Abbott’s opponents waited too long — more than 10 weeks — to challenge an order that was issued July 27.
The opponents also turned directly to the Supreme Court, bypassing lower courts that would have allowed for a “careful, thorough consideration of their arguments,” which included a challenge to Abbott’s authority to issue disaster-related orders on a wide range of issues over the past six months, the court said.
