'Feels like 'bleep'': State warns pub's open-air dining plan still fails COVID rules

BURLINGTON, Wash.—A Burlington restaurant owner is challenging the state after his restaurant was warned to shut-down for using an open-air section as outdoor dining, as officials say it violates coronavirus restrictions.

“Well, it just feels like *bleep*,” said Nick Crandall.

He's been struggling to keep the Railroad Pub and Pizza alive, so now he's using five big garage door windows to have an open-air dining experience. But he received a warning from the Department of Labor and Industries to shut-down, saying indoor dining isn't allowed and his setup doesn’t count as outdoor dining.

“I look at it like I’m a convertible car,” said Crandall. “Show me somewhere that has better airflow than this? I think I only need one door open here, and one down there.”

L &I officials told KOMO News they got several complaints from people concerned about social distancing violations. L & I said they did a spot check, and even with the open plan, it’s considered a solid structure with four walls.
