Federal judge dismisses lawsuit against Seattle's hazard pay for grocery store workers

A federal judge Thursday dismissed a lawsuit that challenged the city of Seattle’s $4-per-hour increase in hazard pay for grocery store workers, which went into effect in February.

Northwest Grocery Association and Washington Food Industry Association (WFIA) alleged in a Feb. 3 filing, the same day the law went into effect, that the ordinance was unconstitutional, violating labor laws and equal protection clauses.

Judge John C. Coughenour wrote in his decision "that none of these arguments establish valid claims for relief" and therefore dismissed the suit.

The Seattle hazard pay only affects grocers with more than 500 worldwide employees and stores in excess of 10,000 square feet or at least 85,000 square feet with 30% or more dedicated to groceries.
