Hillary Clinton Goes Big On Gun Policy, Creates Contrast With Bernie Sanders-HILLARYCLINTON ROOM

WASHINGTON -- Hillary Clinton will call Monday for substantial new limits on the availability and distribution of firearms, stepping aggressively into the debate over gun control in the wake of last week's mass shooting at a community college in Oregon.

The former secretary of state will outline four specific proposals during a pair of town hall events in New Hampshire, all of which are sure to inspire intense opposition from gun rights advocates. One of the proposals will put her directly at odds with Sen. Bernie Sanders (I-Vt.), her top competitor for the Democratic presidential nomination.

ROUGH CUT (NO REPORTER NARRATION) U.S. Democratic presidential candidate Hillary Clinton said on Monday that, if elected, she would use the power of her office to curb gun violence if necessary. Expanding background checks and making it easier to hold negligent manufacturers and dealers accountable would be some of the measures she would take, she said. Clinton has spoken forcefully in favor of new gun control measures after a gunman killed nine people and wounded another nine last week on the campus of Umpqua Community College in Roseburg, Oregon. "How many people have to die before we actually act, before we come together as a nation?" Clinton asked at a community college in Manchester, New Hampshire, which she said was similar to the Oregon campus. Clinton has said she wants to build a "national movement" to counter the influence of the National Rifle Association, the nation's top gun-rights advocacy group. At the Manchester town hall and in background documents provided to reporters, Clinton detailed the measures she would take if elected to the White House in November 2016. Clinton said that if the U.S. Congress will not act, she would use presidential executive authority to close a "loophole" to ensure people buying firearms at gun shows and on the Internet undergo the same background checks and pay the same sales tax as when buying from traditional retailers. Clinton will also push Congress to pass laws that prohibit all domestic abusers, including stalkers, from purchasing guns and to close what she called the "Charleston loophole," referring to a June shooting at a black church in Charleston, South Carolina, that left nine dead. Currently, if a background check is not completed within three days, a gun sale can proceed. The alleged Charleston shooter was able to buy his gun because of this loophole, as did 2,500 people in 2014 who would have otherwise been barred from making such a purchase, Clinton's campaign said. Clinton also reiterated that she wanted to get "military-style assault weapons" off streets, to repeal a 2005 law that she says gives gun manufacturers and dealers "immunity," and to tighten restrictions on straw purchasers who give guns to others. "They're not new," Clinton said of her proposals. "There's nothing unique about them, other than I am so determined to do everything we possibly can." As a U.S. senator representing New York, Clinton voted against the law that prevents victims of gun violence from holding negligent manufacturers and dealers accountable for crimes committed with their guns.

1. Clinton plans to call for lawmakers to address the issue. But if they don't, she will require that anyone “attempting to sell a significant number of guns be deemed ‘in the business of selling firearms,’” which would “ensure that high-volume gun sellers are covered by the same common sense rules that apply to gun stores -- including requiring background checks on gun sales.” Asked what would constitute “a significant number of guns,” a Clinton aide responded, “There are a number of studies being conducted currently regarding illegal gun sales that could inform an eventual rulemaking.”

This is already the law. There may be some more tweaking possible. The challenge is that the federal government has no jurisdiction over the sale of used, legal personal property if there is no interstate component to the sales.

This is telling....

And it’s not clear how it would legally work.

2. Clinton's second proposal would close a gap in the current background check process that “allows a gun sale to proceed without a completed background check if that check is not complete within three days.”

Though probably ineffectual, it is possible to change the process. There will need to be a process in place which will be more costly because as it is if NICS is down or information is slow they do nothing to approve affected background checks, this will require the NICS to follow up or feild incoming calls.

3. Clinton will also call for legislation that prohibits domestic abusers from buying and possessing firearms.

This is already the law, felony or misdemeanor domestic violence convicts are prohibited. Im not sure what she is proposing to change.

4. Finally, Clinton will call for a repeal of the legal immunity that gun manufacturers and dealers currently enjoy under a 2005 law called the Protection of Lawful Commerce in Arms Act.

Ok, the courts are full of frivolous legal actions and people pursuing the frivolous suits end up paying inflated legal fees of the opposition. Thos will not happen...there is a reason this was a bipartisan effort.

Sounds as if he's been all over the place on this one. They played a clip of him saying that we can't be influenced by "the extremes" on this issue. He'll find a way to bring the two sides together (paraphrase).

Gun control is a more difficult issue for Mr. Sanders, who has been gaining on Mrs. Clinton in national polls and leading her in some surveys in New Hampshire and Iowa. The independent from Vermont has a mixed record on the issue, having voted against the Brady Bill in the 1990s and opposing legislation that would have allowed lawsuits against gun companies.


In the aftermath of the Oregon shooting, Mr. Sanders urged “sensible gun-control legislation which prevents guns from being used by people who should not have them.” But he raised some eyebrows when he acknowledged on MSNBC that “I don’t know that anybody knows what the magic solution is.”

On Monday, Mrs. Clinton was less ambiguous. Her voice shook when she introduced the mother of a child who was shot and killed at Sandy Hook Elementary School in Connecticut in 2012, and she was visibly angry when she referred to the National Rifle Association as extremists. While she said she had no problem with the Second Amendment, she said restraints on gun purchases and ownership were needed to reduce crime.

“If you actually ask not only Americans but gun owners, the majority of both say, hey, background checks make a lot of sense,” Mrs. Clinton said. “Let’s do everything we can to make sure the irresponsible and ill don’t get guns.”
