The Court of High Risk Crimes, where Presiding Judge Yassmin Barrios had sentenced retired military Jose Efrain Rios Montt to 80 years in prison, declined to continue with the trial, so it will be transferred to another court.

The Supreme Court shall appoint new judges to serve on the court and continue with the trial from as it was before 19 April.

On May 10, General Efraín Ríos Montt, former military leader of Guatemala, was found guilty of overseeing the deliberate killings by the armed forces of at least 1,771 members of the Maya Ixil population during his 1982-83 rule. He was sentenced to 80 years in prison.
Last Monday, May 20, Guatemalas constitutional court overturned the conviction for genocide and crimes against humanity, throwing out all proceedings in his case since April 19. That was the day the Ríos Montt was temporarily left without a legal defense as his lawyer was briefly expelled from the courtroom after he accused the presiding judge of bias against him.
All the testimonies and witness statements heard from that point onwards will have to be delivered again, in addition to the concluding statements from both sides. Theres no indication of when that will happen.
This is so obviously a charade and a farce that it would be hilarious, except that we are talking about a brutal dictator who on May 10 was convicted of ordering the deaths of almost 2,000 Maya.

(90,061 posts)On the one hand, you can't have heads of state held responsible for their actions while in office, that would be a terrible precedent, and it could cause the actions of other people to be called into question too.
On the other hand, at this point, anything else will get them laughed at and ridiculed, as too obviously rigged, and we already have lots of trouble with our Latin American satrapies because of the Bushites fondness for being obvious bullies.
It would be most convenient at this point if he died of old age or something, then they can try to just sweep it all under the rug, let things cool down.

(35,568 posts)Technically that's what it means but down here, there are no bets. There's a strong, offended attitude from the ruling elite and its lackeys that "you don't just throw Rios Montt in prison". Montt has many powerful friends and his daughter Zuri, married to a former US congressman, is said to be running for President again in the next elections, except that this time she'll have the *sympathy vote* from people who want to make sure they're never dragged into court. I think this is going to be another case of justice denied.
Rios Montt called it from the beginning and said the trial was a *show* for the international community. The current President is slated to get US aid but only if Guatemala shows progress on human rights. So they made a deal and had this trial. Only the current President's name wasn't supposed to be linked to the atrocities and it was during testimony. I don't think there will ever be justice in this case. It's also why Guatemala finally handed over Portillo, with the Guatemalan press calling it a *US kidnapping* because Guate law doesn't allow for extradition. So they threw Portillo, who doesn't have as many friends in high places, to the wolves with a *there, now quit bugging us about Rios Montt* attitude.
Montt's lawyers are demanding his immediate release from the Hospital.

There's a reason rich people here never circulate without bodyguards. If Rios Montt is ever caught by the people, expect something like this. The law of *popular justice* rules in the streets. Even foreigners have been lynched. This is a non-graphic video about that but there are many more, more graphic ones on youtube. They show up on the evening news alot.
Street beatings, burning people alive, and lynching for rape, murder, theft. Imagine what they would do to Montt.
... just when you think they might be getting things together down there, their crooked crony dominated Supreme Court steps in for Monster Montt. Just goes to show... no justice, no peace.

In actuality, the Supreme Court struggled to identify judges to serve on the three-judge appellate court (Sala Primera de Apelaciones) to be convened to implement the Constitutional Courts May 20 order. Scores of judges 59 reportedly, at last count refused to serve on the tribunal.
By Thursday, three days after the Constitutional Courts judgment, the Supreme Court eventually succeeded, at least temporarily, in composing a three-judge appeals court of Judges Frank Martinez Ruiz, acting as presiding judge, Juan Ramón Hernández Pineda and Juan José Rodas Martínez. However, civil party CALDH sought the recusal of Judges Martinez Ruiz and Rodas Martínez, resulting in the successful recusal of the latter on Friday, May 24. (Rodas Martinez had been Guatemalas ambassador to Uruguay, Paraguay and Argentina during Rios Montts rule.) Rodas Martinez was replaced by Judge Frank Trujillo.
