making it, well you know, constitutional. The reason they got it on the ballot as an amendment was so the judges couldn't strike down the law that already existed.

In order to repeal this amendment another one will have to be proposed and passed.

State laws, including their constitutions, are subordinate to the constitution of the United States. That means states cannot write laws that do not adhere to the Founding Document. Thus, a state cannot enact any legislation that does not stand a test of constitutionality.

Well, they can enact it, but they must expect for it to be struck down as either illegal or unenforceable.
