Texas professors ask U.S. court to ban guns in their classrooms

AUSTIN, TEXAS | BY JON HERSKOVITZ

Three University of Texas professors asked a U.S. judge on Thursday to give them the option of barring students from bringing guns into their classroom after the state gave some students that right under a law then went into effect this week.

The professors said academic freedom could be chilled under the so-called campus carry law backed by the state's Republican political leaders that allows concealed handgun license holders 21 and over to bring handguns into classrooms and other university facilities.

"They don't fear, they know that the presence of guns in their classrooms... would squelch (academic) discussions," Renea Hicks, a lawyer for the professors told U.S. District Judge Lee Yeakel.

The lawsuit is seeking a preliminary injunction to halt guns in the classrooms of professors Jennifer Lynn Glass, Lisa Moore and Mia Carter ahead of the start of classes later this month.

Anna Mackin, an attorney for the university, told the judge that if the professors banned guns in their classroom, they would be violating state law, and could be disciplined or terminated.

5. The AG for Texas (Paxton) is suing the city of Austin

because the city has banned weapons at the city hall.

Open carry is allowed at the state capitol where the legislators meet.

Guns are still banned in court rooms which would include the Texas Supreme Court.

I don't believe that guns are allowed at the governor's mansion.

3. No Ruling in Campus Carry Court Challenge

A federal judge took no action Thursday on a request by three University of Texas at Austin professors to temporarily block Texas' campus carry law, saying he won't give his initial ruling until at least next week.

But the case against gained a new wrinkle at a hearing Thursday, with the professors' lawyers now adding a claim that UT-Austin's gun policies are too vague to be enforced.

It remains to be seen whether the challenge will go anywhere. Lawyers on the professors' side admitted in court that their claims wade into uncharted legal waters.

"It goes without saying that this is an interesting case," said U.S. District Judge Lee Yeakel. "Both sides, I thought, did an exceptional job."

You know, the poster that magically will somehow know if there is a concealed gun in "his" classroom?

I'm surprised he hasn't weighed in on the issue yet.

Especially since they are discussing terminating any professor that refuses to abide by the law.

(Not really, with 9 hides or so in 90 days he must be on good behavior)
