On February 2, a three-judge panel of the U.S. 5th Circuit Court of Appeals, an increasingly reactionary body packed with Trump appointees, overturned a federal ban on gun possession by people subject to domestic violence restraining orders. In a 24-page ruling, the panel explains how it applied Bruen’s new framework for deciding Second Amendment cases: In order for a gun law to be constitutional, the government must prove that it is well established in America’s “historical tradition of firearm regulation.” Because domestic violence wasn’t a crime in the 18th and 19th centuries, nor for most of American history, the 5th Circuit declared the ban unconstitutional.

**It’s the latest example of how Bruen is reshaping U.S. gun laws — and in the three states where the ruling applies, The Trace’s Jennifer Mascia and Will Van Sant write in their analysis of the decision, victims of domestic violence could now be in peril.

How many here think this makes sense and is in keeping with “historical tradition of firearm regulation”?

1. You and I are usually at the opposite extremes of RKBA stuff

but even I think this is utter bullshit.

Guns, I have a bunch of them (all secured via biometric means of course), I have zero problems with lethal self-defense if threatened... but even 'gun humper' me knows damned well THERE ARE PEOPLE WHO IN NO FUCKING WAY SHOULD BE EVEN NEAR A GUN!! And domestic abusers have to be at the top of that list.

Geeze; I've had two 'acquaintances' who were domestic abusers; those POSs shouldn't have been near a chopstick, to say nothing of a firearm.

2. I'm not surprised.

Like you I have a number of guns secured safely. I'm not afraid of guns. I'm afraid of the gun culture and it's insane grip on the US. Bruen is the logical conclusion of the zero tolerance mindset fostered by gun makers and the gun owners they have brainwashed.

There is redemption if forgiveness is asked and you sin no more
