African American Valedictorian barred from his own high school graduation

because he has a beard.

Apparently this high school doesn't realize that their rule could be in violation of the Civil Rights Act.

An employer’s policy might still be discriminatory, even if the employer didn’t intend to discriminate. In a “disparate impact” case, a seemingly neutral policy is discriminatory if it has a disproportionate impact on employees in a particular class. For example, a policy that requires male employees to be clean shaven might have a disproportionately negative effect on African American employees, who are more likely to have a skin sensitivity to shaving. In this situation, the employer must be able to show that its requirement is related to the job and consistent with business necessity. If, for example, the employer’s policy is based simply on the owner’s preference for clean-shaven employees, that’s not a good enough reason to justify a policy that has a discriminatory effect.

Things got hairy at a Louisiana high school graduation when the valedictorian was not allowed to participate because he took a stand over his goatee.

Andrew Jones was the head of his class at Amite High School, but education officials said what’s on his chin violated the policy against facial hair, according to WWLTV.

The 4.0 student had worn his beard for four years, but he and 13 others were told that they had to shave after arriving at their graduation ceremony Wednesday night.

Jones, who was set to given an address at the event, refused because the rule had never been enforced before, so his cap and gown were taken away.

a violation of the Civil Rights Act, since black men are more susceptible to a skin condition that is worsened by shaving.

So I don't think they have a legal leg to stand on no matter what.

A friend working years ago at a hotel desk - shave your face said the manger that's the rules
He gets those bumps but needed the job
When his mangers saw his bumps he told him he didn't have to shave and could stay on at the job
Now days if you have money you can laser it but high school kids ? Keep a little beard no bumps

unless they're needed for safety (like firefighters masks). Rules like that are discriminatory against black men who are more likely to have that skin disorder if they shave.

If he did not have a beard they would have found some other nonsensical way of excluding him.

He has dark skin.

No way he was going to make the Val speech. They just found some shit to get him on.

I bet the next up to make the speech was lily white.

BTW - white people have a different perspective on racism. Racists often assume other white people are racist and they say all kinds of sick shit. I can't even begin to describe what I have heard.

Honestly, the beard had nothing to do with it.

My father had them as does my brother . ..

They used/use magic shave.

This is a tough one for me because facial hair was not allowed at my high school . . . Period.

They should have let these kids know in advance.

Even with that I'd have been possibly screwed because my skin is EVEN MORE sensitive than even the average for Black people so if I use it more than once every 3-5 days, it absolutely ravages my skin, especially the extra strength kind.

When he takes off his beard. He's Calabrese and it grows thick and quick. Picked it up from my dad.

When he grooms it he used to get ingrown until . . . Tend Skin. Now my brother uses it too. Walgreen for $9. He also has super sensitive skin.

Who knew!

It's a liquid in a blue bottle. Put it on a cotton ball after you shave - no bumps very soothing.

He uses the black and tan powder!

And it's not as though we're saying or even thinking anything unsavory towards this young man. Just acknowledging that he is a very cute little bug, and his little "I'm all Growed Up!" beard makes it even more so.

It's supposed to be young. It's supposed to be thin. And the vast majority of the time, it's supposed to be white or as close to that as possible. These are all lies.

Beauty comes in as many different forms as there are women.

You know, the guy who relates everything to his time in the service.

But...

I have to say this. Black men susceptable to shaving bumps (psuedofoliculitis barbae) can wear trimmed beards in all of the branches of the DOD.

I am damned sure that the dress and appearance standards of this school are mot as strict.

So, yeah this is BS

The Tangipahoa chapter of the NCAAP is planning the rally — Jones is African-American — and the chapter discovered photos of white students with facial hair participating in graduation in previous Amite High ceremonies.

so they're probably used to white students being the Valedictorian, just based on the odds. It must have been really disturbing for at least some of them to see an assertive, smart young black man about to get that honor.

First, it's a public school, so they need to show a compelling state interest. They haven't.

But I don't like dress codes because they have the effect of robbing students of their individuality. Rules should be reasonable and not egregious and only to preclude the most extreme examples of students dressing inappropriately. When in doubt, in a close call, I believe schools should err on the side of free expression.

I'll support this kid's right to wear a beard as much as I will support the right of some redneck kid to wear a confederate flag t-shirt.

Today there is a story in the news from Texas about a girl who got sent home for wearing a pro-LGBT t-shirt. Again, totally outrageous.

His beard is a statement about himself and nothing else.

The confederate flag in 2016 makes the statement "I don't like black people."
