An employers policy might still be discriminatory, even if the employer didnt intend to discriminate. In a disparate impact case, a seemingly neutral policy is discriminatory if it has a disproportionate impact on employees in a particular class. For example, a policy that requires male employees to be clean shaven might have a disproportionately negative effect on African American employees, who are more likely to have a skin sensitivity to shaving. In this situation, the employer must be able to show that its requirement is related to the job and consistent with business necessity. If, for example, the employers policy is based simply on the owners preference for clean-shaven employees, thats not a good enough reason to justify a policy that has a discriminatory effect.

Things got hairy at a Louisiana high school graduation when the valedictorian was not allowed to participate because he took a stand over his goatee.
Andrew Jones was the head of his class at Amite High School, but education officials said whats on his chin violated the policy against facial hair, according to WWLTV.
The 4.0 student had worn his beard for four years, but he and 13 others were told that they had to shave after arriving at their graduation ceremony Wednesday night.
Jones, who was set to given an address at the event, refused because the rule had never been enforced before, so his cap and gown were taken away.

So I don't think they have a legal leg to stand on no matter what.

He gets those bumps but needed the job
When his mangers saw his bumps he told him he didn't have to shave and could stay on at the job
Now days if you have money you can laser it but high school kids ? Keep a little beard no bumps

He has dark skin.
No way he was going to make the Val speech. They just found some shit to get him on.
I bet the next up to make the speech was lily white.
BTW - white people have a different perspective on racism. Racists often assume other white people are racist and they say all kinds of sick shit. I can't even begin to describe what I have heard.
Honestly, the beard had nothing to do with it.

This is a tough one for me because facial hair was not allowed at my high school . . . Period.
They should have let these kids know in advance.

(1,151 posts)Even with that I'd have been possibly screwed because my skin is EVEN MORE sensitive than even the average for Black people so if I use it more than once every 3-5 days, it absolutely ravages my skin, especially the extra strength kind.

When he grooms it he used to get ingrown until . . . Tend Skin. Now my brother uses it too. Walgreen for $9. He also has super sensitive skin.
Who knew!

He uses the black and tan powder!

I have to say this. Black men susceptable to shaving bumps (psuedofoliculitis barbae) can wear trimmed beards in all of the branches of the DOD.
I am damned sure that the dress and appearance standards of this school are mot as strict.

The Tangipahoa chapter of the NCAAP is planning the rally Jones is African-American and the chapter discovered photos of white students with facial hair participating in graduation in previous Amite High ceremonies.

(108,978 posts)so they're probably used to white students being the Valedictorian, just based on the odds. It must have been really disturbing for at least some of them to see an assertive, smart young black man about to get that honor.

(44,173 posts)First, it's a public school, so they need to show a compelling state interest. They haven't.
But I don't like dress codes because they have the effect of robbing students of their individuality. Rules should be reasonable and not egregious and only to preclude the most extreme examples of students dressing inappropriately. When in doubt, in a close call, I believe schools should err on the side of free expression.
I'll support this kid's right to wear a beard as much as I will support the right of some redneck kid to wear a confederate flag t-shirt.
Today there is a story in the news from Texas about a girl who got sent home for wearing a pro-LGBT t-shirt. Again, totally outrageous.
