De'Von Bailey lawsuit against city of Colorado Springs settled for nearly $3 million

The Colorado Springs City Council approved a $2.97 million settlement Tuesday in a civil lawsuit brought by the estate of De'Von Bailey, a 19-year-old Black man shot in the back four times by police in 2019.

The suit names the city of Colorado Springs and police Sgt. Alan Van't Land and officer Blake Evenson, who opened fire on Aug. 3, 2019, killing Bailey and igniting repeated protests. A grand jury rejected filing criminal charges against the two Colorado Springs police officers involved in the fatal shooting.

The City Council voted 7-2 to approve the settlement that includes non-monetary provisions, such as anti-bias training, in the case that alleged wrongful death, denial of equal protection and excessive force. The case also claimed officers engaged in racially discriminatory policing.

In an interview with The Gazette, Lawrence Stoker, Bailey's cousin who was also stopped by police that day, said no amount of money would bring his cousin back. Stoker, 21, was not part of the settlement.

Colorado city settles suit in police shooting of Black man

COLORADO SPRINGS, Colo. (AP) — The city of Colorado Springs has reached a nearly $3 million settlement in a civil lawsuit brought by the family of a 19-year-old Black man who died after being shot in the back by police officers in 2019.

De’Von Bailey’s death spurred protests against the use of excessive force by police and helped lead to several police accountability laws in Colorado. The family’s federal lawsuit alleged civil rights violations, racial bias in policing and wrongful death.

The Colorado Springs City Council approved the $2.97 million settlement Tuesday, The Gazette reported. The settlement also calls for anti-bias training for the department’s police officers, the department said.

Police body camera footage showed officers talking to Bailey and another man about an armed robbery reported nearby in southeast Colorado Springs. Bailey ran as he was about to be searched. An officer could be heard yelling “Hands up!” three times before firing.

1. Let the cops defund themselves.

Just take those settlements out of their budgets. Would go a long way in stopping the Blue Line. Bad cops would be run off instead of protected by fellow cops if it cost all of them.
