Prosecutors seek recusal of judge for 'media whore' comments in Adrian Peterson case
Montgomery County prosecutors are seeking the removal of the judge in the Adrian Peterson child abuse case, asserting that the judge has been involved in several highly publicized clashes with prosecutors and once referred to attorneys in the case as "whores" or "media whores."
Phil Grant, an assistant Montgomery County prosecutor, said the district attorney's office plans to file a motion for recusal Wednesday afternoon regarding Judge Kelly Case.
At a hearing in Conroe Wednesday morning, District Attorney Brett Ligon demanded that Case apologize for his remarks. Ligon alleged that on Oct. 2 the judge referred to Peterson's attorney, Rusty Hardin, as a "whore" and that Case had also called Ligon "a 'whore' or 'media whore.'"
The judge seemed taken aback and said he had meant the remarks as a "humorous joke," but that sometimes humor is taken the wrong way. Ligon countered that there is now "very little humor" between the judge and the district attorney's office. He was apparently referring to a series of recent skirmishes between the judge and DA's office, each of which has led prosecutors to file court papers challenging the judge's orders and asking appellate courts to order him to follow the law.
