Its a crime under the Espionage Act to willingly, or inadvertently, transfer 22 Top Secret emails from secure State Department servers, to an unguarded private server. Clintons server was unencrypted for three months.
Under the Espionage Act, gross negligence is enough to prosecute, so intent isnt needed when evaluating the harm done to national security from an unencrypted private server containing Top Secret emails. Simply claiming ignorance, or disinterest, or naiveté in using a private server isnt enough to circumvent criminal indictments under the Espionage Act.
Therefore, the basis for imminent indictments rests upon the fact that neither the State Department, nor the president gave Clinton the authority to use a private server.

(12,011 posts)It is up to the parties, and as far as I can tell the DNC doesn't really have a procedure laid out for replacing a nominee after he/she has been formally nominated. This wasn't an issue in 1968 because RFK was shot after locking up the nomination (there were no supers back then) but before actually being nominated.

(12,011 posts)In some states if a candidate dies their name stays on the ballot and then if they win a special election is held or an appointment is made. In some states a replacement can be picked quickly. In Minnesota in 2002 leaving Wellstone's name on the ballot was not an option, which sucked because he probably would have won posthumously. What was really unfair was that they counted the absentee ballots that went for Coleman, despite having a different opponent, but the absentee ballots that were cast for Wellstone did not count for Mondale.

Take this for example, CNN didn't report on the occupyCNN protest that was happening outside their building, RT did (Yes, that's Russian Television), but from what I've seen they have a lot of integrity. Maybe there's a reason Larry King left CNN to work there?
