Comey: Clinton did not lie to the FBI

“Director Comey said my answers were truthful, and what I’ve said is consistent with what I have told the American people, that there were decisions discussed and made to classify retroactively certain of the emails.”
—Hillary Clinton, interview on “Fox News Sunday,” July 31, 2016

Clinton made these remarks after “Fox News Sunday” host Chris Wallace played a video of her saying: “I did not email any classified material to anyone on my email. There is no classified materials. I am confident that I never sent nor received any information that was classified at the time. I had not sent classified material nor received anything marked classified.”

As Wallace put it, “After a long investigation, FBI Director James Comey said none of those things that you told the American public were true.”

Is what Mike Wallace said in the last sentence above accurate?

Hillary Clinton did not lie to FBI investigators during their probe into her use of a private server as secretary of state, FBI Director James Comey testified Thursday.

"We have no basis to conclude she lied to the FBI," Comey told House Oversight Chairman Jason Chaffetz (R-Utah) during one of the hearing's opening exchanges.

Asked whether Clinton lied under oath, Comey remarked that she did not do so to the FBI

"Did Hillary Clinton break the law?" Chaffetz asked.
"In connection with her use of the email server? My judgment is that she did not," Comey said.

Chaffetz then asked whether it was that he was just not able to prosecute it or that Clinton broke the law.

"Well, I don't want to give an overly lawyerly answer," Comey said. "The question I always look at is IS there evidence that would establish beyond a reasonable doubt that somebody engaged in conduct that violated a criminal statute, and my judgment here is there is not. "

GOWDY: Secretary Clinton said there was nothing marked classified on her emails either sent or received. Was that true?
COMEY: That’s not true.
GOWDY: Secretary Clinton said, “I did not email any classified material to anyone on my email. There is no classified material.” Was that true?
COMEY: There was classified material emailed.

To Clinton’s assertion that she never sent or received information marked classified on her private email,

Comey pointed to the investigation’s findings to the contrary.

"That's not true.

There were a small number of portion markings on I think three of the documents,” Comey said. (The State Department on Wednesday said that two of those documents were inadvertently marked.)

On Clinton’s statement that she did not email classified material to anyone, Comey responded, “There was classified email.”

Asked about the three documents with the “c” markings suggesting that the lines included classified information, Comey told Rep. Matt Cartwright (D-Pa.) that they were not properly marked in accordance with the State manual.

“According to the manual, if you’re going to classify something, there has to be a header on the document, right?” Cartwright asked, to which Comey responded in the affirmative.

Asked whether there was a header that contained the “c” in the text, Comey said the “c” denoting classified material “was in the body in the text but there was no header on the email or in the text.”

“So if Secretary Clinton really were an expert at what's classified and what’s not classified and we're following the manual, the absence of a header would tell her immediately that those three documents were not classified,” Cartwright remarked. “Am I correct in that?”

Comey called it a “reasonable inference.”

Appreciate it if you would correct the name to Chris in your bolded statement.

Great post. Pisses me off too that WAPO "fact"-checkers ignored Comey's statements while under OATH

... to answer people when canvasing. I think I'll just print this out and hand it to them, explaining that it's very complicated, but the bottom line is that she didn't lie.
