Most class action lawyers work on contingency - I think it is frowned upon if not prohibited in some courts for class action lawyers to charge a fee upfront.

However, I think this would be a tough case to do as a class action, because the claims would be for breaches of different contracts for different types of work under different circumstances. Thus, it would be difficult to convince a court that common issues of law and fact predominate over individual ones, which is one of the tests you have to meet to get class certification. I would also imagine that the statute of limitations has run for many of these businesses, and that many of those cases were already settled in some form.

That said, if a small business owner came to my firm about it we would certainly take a look at the facts and see if there was any way to do this.
