Supreme Court refuses to block lawsuit against gun manufacturer brought by Sandy Hook families

WASHINGTON – The Supreme Court refused Tuesday to shield a major arms manufacturer from potential liability in the 2012 school shooting that left 26 students and educators dead in Newtown, Conn.

The justices' action allows a lawsuit filed by parents of Sandy Hook Elementary School victims to move forward at the state level, on the allegation that Remington Arms Co. marketed the military-style rifle used in the mass shooting "for use in assaults against human beings."

Bernie Sanders voted FOR the 2005 law that shields gun manufacturers from liability. In 2016 during the campaign he defended his vote.

...gets the nomination, I will absolutely vote for him.

BUT...this was an issue I was very upset with him about! I mean...go after billionaires, but by all means leave the gun manufacturers alone? Seriously??

to vote for Bernie if he wins the nomination. We have to beat Trump as all cost! I am still mad at him for this though.

A lot of Vermonters are employed making guns, so he wouldn't want to piss off his constituents. When you're a representative, you have to keep your votes generally in line with the opinions of the voters. There are times to be courageous and vote the way you think is best instead of what the voters want, but when you talk about messing with people's livelihood, it's best to toe the line.

The narrow state court decision limited liability for gunmakers based on how they advertise their firearms, rather than on the sale to third parties who go on to commit crimes. In its ruling, the court said companies that market military-style guns to civilians as a way of killing enemies could be violating state fair trade laws.

Even so, the decision was seen as having broad implications for gun-control advocates across the country who have had little success in seeking ways to hold gunmakers responsible for crimes committed with their products.

Firearms company Remington had convinced a lower court that federal law prevented the families’ lawsuit. But Connecticut’s high court said that the law had exceptions and that one of them was meant for state consumer protection laws.

The NRA fought hard to get the immunity from Congress, saying it was needed to protect U.S. companies from costly, and what they see as unfair, litigation that blames them for the crimes of others.
