No charges made in New York City subway shooting as police cite self-defense - NBC News

No charges were made against the man who shot another subway rider with his own gun during a fight in a New York City subway. A 36-year-old man was shot multiple times during the altercation and was rushed to the hospital where he is in critical condition. Police say the other passenger was acting in self-defense.

and clearly no longer a danger ... (does not appear to be the case) Don't see that there's really even any question. I'd hope to be accorded the same rights and protection under the law.
