New Mexico County Clerk Begins Issuing Marriage Licenses To Same-Sex Couples

Doña Ana, New Mexico, County Clerk Lynn Ellins (D) announced Wednesday that his office would begin issuing marriage licenses to same-sex couples. The move comes days after the state’s Supreme Court declined to expedite a marriage equality case, saying the case should first go to a lower court.

New Mexico has no constitutional prohibition on same-sex marriage and no explicit statutory ban — but still has not previously allowed the practice. A recent review of state codes by state Attorney General Gary King (D) found that while some statues implicitly require that marrying couples include one male and one female, the equal protections required by the state’s constitution render these rules unconstitutional. King said he would not fight any lawsuit demanding same-sex marriage equality.

Noting the Attorney General’s advisory opinion, Ellins decided he would not wait for the case to wend its way through a lengthy judicial process:

After careful review of New Mexico’s laws it is clear that the state’s marriage statutes are gender neutral and do not expressly prohibit Doña Ana County from issuing marriage licenses to same-gender couples. Any further denial of marriage licenses to these couples violates the United States and New Mexico Constitution and the New Mexico Human Rights Act. Doña Ana County is upholding New Mexico law by issuing these marriage licenses, and I see no reason to make committed couples in Doña Ana County wait another minute to marry.
For a few hours, a Sandoval, New Mexico county clerk allowed same-sex marriages in 2004. Sixty-four couples married in that brief window, but their status has never been fully resolved by the state courts.

Best headline ever? Man in his underpants danced on the wing of Angela Merkel’s jet

The man, a bodybuilder of Turkish descent named as Volkan T, 24, danced on a wing of the German chancellor’s aircraft, sprayed fire extinguisher foam around its luxury cabin and randomly pushed cockpit buttons, deploying an emergency evacuation slide.

According to a leaked police report, the man easily boarded the Airbus 319 on 25 July, clutching a bag full of marijuana and ecstasy pills, while it was parked at a closed military section of Cologne airport.

The authorities were only alerted to the security breach, when he inadvertently triggered an alarm while playing with the cockpit buttons.

Adding to the embarrassment, it then took police, dogs, private security guards and soldiers three hours to get the intruder off the plane, including attempts to persuade him to give up shouted over a megaphone.

The Federal state aircraft was loaded with up to eight tons of fuel, enough to take it to Beijing and it was ready to fly if the intruder had known how.

Beau Biden Has A Mass in His Brain

Vice President Joe Biden has canceled an event Thursday in Rhode Island to remain in Houston while his son is being evaluated at a Texas cancer center.

Biden was scheduled to headline a fundraiser for the Democratic National Committee at the home of Alison and Bill Vareika, which has been canceled.

The White House hasn't said whether Biden's other events this week have also been canceled. Biden was to attend a fundraiser in New Hampshire and an event at Salve Regina University in Rhode Island Thursday, and join President Barack Obama in Pennsylvania at a Friday event. Salve Regina University says the event there may also be canceled.

Delaware Attorney General Beau Biden has a mass in his brain and is being evaluated at the University of Texas MD Anderson Cancer Center, according to NBC News.

A School Clerk persuaded Gunman To Lay Down Weapons

Tuesday's terrifying incident at an elementary school near Atlanta — in which a gunman with an assault rifle and other weapons entered the building — ended with no one being hurt after a school clerk apparently spent about an hour talking to the young man. She says she persuaded him to put his gun down and surrender.

"I just started praying for him," Antoinette Tuff tells Atlanta's Channel 2 Action News. "I just started talking to him ... and let him know what was going on with me and that it would be OK. And then let him know that he could just give himself up. ... I told him to put [the guns] on the table, empty his pockets. He had me actually get on the intercom and tell everybody he was sorry too. But I told them, 'He was sorry, but do not come out of their rooms.' ... I give it all to God, I'm not the hero. I was terrified."

In an interview with ABC-TV's World News with Diane Sawyer, Tuff says

"[I saw] a young man ready to kill anybody that he could and take any lives he wanted to." According to ABC:

"The school clerk said she tried to keep the assailant calm by asking him his name but, she said, at first he wouldn't tell it to her. Then, he began listening to her tell her life story. She said she told him about how her marriage fell apart after 33 years and the 'roller coaster' of opening her own business."

Tuff says she told 20-year-old Michael Brandon Hill that "OK, we all have situations in our lives. I went through a tragedy myself."
Then, ABC writes, "Tuff made the request that she said helped end the standoff. She said she asked the suspect to put his weapons down, empty his pockets and backpack and lay on the floor. 'I told the police he was giving himself up. I just talked him through it,' she said."

Fogbow


SEATTLE - While rainbows are quite common around here, fog bows are more rare.
Fog bows are generally seen as an arc of dense fog along the edge of a fog patch. The physics is somewhat similar -- in that the bow is caused by sunlight refracting inside water droplets.

However, unlike rainbows, where the raindrops are large enough to refract sunlight into its individual colors, the water droplets in a fog bow are much smaller, and so the refractions aren't as precise.

Thus, the way the light scatters from a fog bow, you get a lot of color overlapping, and more of a hazy white bow instead of the colorful rainbow.

BREAKING: Elmore Leonard has passed.

Elmore Leonard -- the legendary writer behind "Get Shorty," "3:10 to Yuma" and "Justified" -- has died, three weeks after suffering a stroke ... TMZ has learned.

We're told Leonard passed away at his home in Detroit ... the city where he lived since 1934.

E.L. is a legend -- dozens of his novels and short stories have been transformed into movies or TV shows ... including "Out of Sight," "Be Cool," "Hombre," "Mr. Majestyk" and "3:10 to Yuma."

Elmore's researcher broke the news on the author's Facebook page ... writing, "The post I dreaded to write, and you dreaded to read. Elmore passed away at 7:15 this morning from complications from his stroke. He was at home surrounded by his loving family."
