if I understand what dems are doing, there is some disagreement whether it is legal to do that unless two of the minority party votes. Dems could protest but they will not for a good reason. If the democrats win the Presidency and Senate they can stack the court as much as they want since if it was OK for the GOP then they will not have a leg to stand on when dems do the same.
