The (Ir)relevance of the Trump Dossier

Much has been made this week of reports that the Clinton campaign paid for the so-called “dossier” about Trump that was compiled by a former British intelligence agent. One important point is sometimes lost in the discussion. The dossier itself played absolutely no role in the coordinated intelligence assessment that Russia interfered in our election. That assessment, which was released in unclassified form in January but which contained much more detail in the classified version that has been briefed to Congress, was based entirely on other sources and analysis.

It’s true that then President-elect Trump was briefed on the allegations in the dossier. This was not, however, because the Intelligence Community had relied on it in any way, or even made any determination that the information it contained was reliable and accurate. Rather, after considerable thought and discussion, DNI Clapper and the heads of the FBI, CIA and NSA decided that because the dossier was circulating among Members of Congress and the media, it was important to warn the President-elect of its existence. Imagine his anger – which would have been fully justified – if the document had leaked and he learned that U.S. government agencies knew of it and did NOT warn him.

The Russian efforts to influence our election are an important crisis for our democracy. The salacious allegations in the “dossier” are a mere sideshow that should not distract from a comprehensive investigation of that crisis.

What can we glean from all this?

It is unlikely that Secretary Clinton personally participated in the transaction. Her assistant secretary says she did not intervene, and given the nature of the transaction and the apparent lack of controversy, that is a plausible scenario. I can see no reason to doubt his account.

The structure of CFIUS is such that no one agency can control the outcome of the consideration. Here it appears that the entire committee and the NRC were all satisfied with the mitigation put in place. It is a very far stretch to lay this result at State's doorstep—the vigorous objection of any of the security-minded agencies would likely have derailed the transaction, but none, evidently was forthcoming. I have no doubt that State favored the sale—but that is likely the position it would take today under Secretary Rex Tillerson and was surely the position it would have taken under Secretaries Colin Powell, Condoleeza Rice and John Kerry. State has a strong institutional bias in favor of accommodating foreign investment in the United States. Here, it seems clear that the Pentagon and DHS did not object either.

The inherent bias of the process is to approve transactions, with mitigation if needed. Intervention and blocking are rare and require more than a single agency to be activated. Put another way, no single agency has a veto on the transaction—the transaction goes forward unless a substantial majority of CFIUS is motivated by grave concerns to block it. So the most accurate way to characterize this case is that State, along with all the other agencies, declined to recommend a presidential veto.

Uranium One's licenses are for mining and extraction, not for export. This makes the claim that we "gave away" 20% of America's uranium fairly hyperbolic. The expectation, in light of the NRC's assessment, would have been that the uranium mined would be marketed in America (with the profits going to Russia).

It is, however, true, that the mining rights to 20% of American uranium are now held by a Russian state agency. That is troubling (and had it been me, I would have tried to generate opposition to the sale). It isn't a "give away," but it is the case that Rusatom has de jure and de facto legal rights that can be exercised to limit production if it wishes to do so.

Look back at almost countless articles on the so-called Steele Dossier and you’ll find the same basic account. The project began as an opposition research project funded by Republicans during the GOP primaries when, of course, there were Republicans with an interest in finding damaging information about Donald Trump. After Trump sealed the GOP nomination, Republicans had no desire or interest in funding this research. So Democrats agreed to start footing the bill.

Is this new? Not really. Here is I believe the first reporting on what we now know as the Steele Dossier. It’s an October 31st (2016) report from David Corn in Mother Jones, reporting how a veteran spy had provided information to the FBI about a Russian operation to cultivate Donald Trump.

In any case, there’s a big effort now to present this as somehow being a scandal in itself, or discrediting Steele’s sleuthing. That is ridiculous. Is it really a scandal that Democrats helped fund research into Donald Trump’s illicit ties to Russia after Republicans donors decided they didn’t care anymore?

Not really.

The Trump team wanted to deliver for Russia right out of the gate in January, a quick series of accommodations and a ‘grand bargain’ with Vladimir Putin. It was the investigation into Trump’s ties to Russia that got in the way and mainly prevented it. It’s clear that Steele’s research played a major role in that. Remember, the FBI found it so critical it agreed to continue funding Steele’s research. Without Marc Elias’s decision, that research may never have been conducted. The country owes him a debt of gratitude.

The New Yorkers new cover is out and some people think its gone too far. Warning: scary clown

A new cover from “The New Yorker” is causing some strife on conservative social media sites with its cartoonish depiction of President Donald Trump. “October Surprise,” by Carter Goodrich depicts President Donald Trump in a fat, clown suit and makeup.

The clown version of President Trump peers out from within a forest, with an evil smile wrapped around his face. The cartoon, clown Trump is more akin to something out of a Steven King horror novel, than anything pleasant.

When the cover was released, conservative social media went into a frenzy, including one of Trump’s biggest supporters.

iven what we know today, there are several important events in the Trump election timeline that deserve re-examination.

During an interview on Wednesday night with CNN’s Anderson Cooper, author Joshua Green revealed how he was invited into the data bunker of President Donald Trump’s inner sanctum during the final months of the 2016 presidential campaign.

Green, the author of “Devil’s Bargain,” explained that he and his colleagues were there so that the campaign could show off what they were doing.

Trump’s staff “wanted to show off they had different sources with opposing” scenarios, Green said. “They had a team of Cambridge [Analytica] scientists embedded in the Trump headquarters in San Diego doing sophisticated modeling work to help to inform where the campaign was going to send Donald Trump.”

The main locations identified by the CA team were Grand Rapids and Warren, Michigan, as well as Green Bay, Wisconsin. Perhaps not uncoincidentally, The New Yorker featured a story on October 31, 2016 asking why Trump was spending all of his time in those two states specifically.

“According to the polls, Donald Trump [had] been trailing Hillary Clinton badly in Michigan and Wisconsin for months,” reporter John Cassidy wrote at the time, citing two polls that showed Clinton in the lead by seven percentage points. He cited a third poll where the margin was six points. “It’s a similar story in Wisconsin, where the past three polls have shown Clinton ahead by four points, six points, and seven points.”

Cassidy then asked why –“with just more than a week left before Election Day — is Trump campaigning in these two states?” He said that it seemed smarter to him that Trump should be in places like Florida, Nevada, North Carolina and Ohio, where the polls were closer.

The Wall Street Journal also reported weeks before the election that the Trump campaign believed they could make inroads in those areas. They also claimed to “seek to create a bigger-than-expected turnout among Trump’s core demographic, and [they banked] on Democratic turnout being low.”

According to Sen. Richard Burr (R-NC), the ads were generated by or linked to Moscow-linked bots — and tied to Michigan and Wisconsin. There were a few other ads in other states, but Burr specifically cited Michigan and Wisconsin.
