MyPillow launches yet another effort to get Dominion's defamation lawsuit dismissed

Attorneys for Mike Lindell's pillow company are making yet another effort to dismiss a $1.6 billion defamation lawsuit from Dominion Voting Systems.

In court filings Tuesday, the lawyers asked the judge overseeing the case if an appeals court can reconsider the legal standards that allow Dominion to proceed with its lawsuits. The company first filed its lawsuit against Lindell and MyPillow in February, as Lindell promoted false conspiracy theories about the election technology firm's role in the 2020 election.

The CEO had pushed the theories in part to promote sales for MyPillow products, Dominion alleged. Lindell has continued to promote the false theories and hosted a "symposium" about them earlier in August.

Lawyers for Lindell and MyPillow, each named as separate defendants, have tried to get the lawsuit dismissed, arguing that the CEO's claims could not be considered defamatory because they were made as part of political discourse. But US District Judge Carl J. Nichols ruled that Dominion's lawsuit against them — as well as parallel ones against Sidney Powell and Rudy Giuliani, who promoted other false theories about Dominion — could move forward.

State officials open investigation into whether Larry Elder failed to disclose income sources

California regulators have launched an investigation into whether recall election gubernatorial candidate Larry Elder failed to properly disclose his income sources, a spokesman with the Fair Political Practices Commission confirmed on Sunday.

Elder, like all candidates for public office, was required to file a public statement of economic interests that discloses some aspects of his personal finances, including stocks, gifts, real estate that he owns and sources of income. The document is supposed to show the public whether a candidate for office would have conflicts of interest in his or her decisions.

Elder’s initial filing was only two pages long and only showed income from Laurence A. Elder and Associates Inc. A Times article earlier this month first reported that Elder likely failed to properly disclose his finances because he appeared to own the company, meaning he was also required to report ownership in the business as well as income sources to the company above certain amounts.

After the Times story, the California Democratic Party filed a complaint with the Fair Political Practices Commission alleging that Elder failed to properly disclose the business and its sources of income. Elder, a conservative radio show host, amended the document to show that Elder owned 100% of the company and that it is worth between $100,000 and $1 million. His exact wealth is difficult to determine because the state requires disclosure in broad dollar ranges.

City hosting Trump rally in Alabama declares COVID-19 emergency

Cullman, Ala., on Thursday declared a COVID-19-related state of emergency ahead of a scheduled Alabama GOP rally featuring former President Trump on Saturday as Alabama struggles with a surge in new infections and a shortage of hospital beds.

The state of emergency declaration allows the city to provide additional resources for the rally, a request that was made by the chief operating office of Cullman Regional Medical Center, which is experiencing overcrowding amid a spike in coronavirus-related hospitalizations.

Alabama saw 3,890 new COVID-19 cases on Wednesday, with a seven-day moving average of about 3,000 new infections, according to the Center for Disease Control and Prevention’s Covid Data Tracker. Cullman Regional’s latest update on Wednesday showed that the hospital was treating 56 coronavirus patients, including 12 people who are on ventilators.

The Alabama Hospital Association also revealed on Wednesday that the state has run out of intensive care unit beds, reporting a 29-bed deficit.

Judge grills lawyers for Fox News, Powell, Giuliani about election fraud claims in $2.7 billion Smartmatic defamation suit

A skeptical-sounding judge on Tuesday questioned lawyers for Fox News, Rudy Giuliani and Sidney Powell about a series of election-fraud claims at the center of a $2.7 billion defamation lawsuit filed against them by voting technology firm Smartmatic.

The company, which only provided services to Los Angeles County in the 2020 election, accuses the defendants of spreading the false story that it rigged the race against former President Donald Trump.

In virtual oral arguments on Fox’s bid to have the case dropped, Manhattan Supreme Court Judge David Cohen pressed counsel for the conservative news outlet about specific claims made on its air by current and former hosts Maria Bartiromo, Jeanine Pirro and Lou Dobbs.

“How is that not defamatory?” Cohen at one point asked Fox attorney Paul Clement after referencing a claim from Dobbs in mid-November that Smartmatic had been banned in Texas. The company had not been banned in the state.

Just signed my California recall ballot.

Voted no on the recall and didn't select a successor. Just an FYI there were several candidates that were Dems. I hope I did it right.

Trump mocked after sending out another bizarre press release asking 'do you miss me yet?' in all cap

Former president Donald Trump began his Friday by issuing a statement asking Americans: “DO YOU MISS ME YET?

*snip*

Putting the unhinged use of all caps aside, Twitter users were quick to mock Mr Trump and remind him of his own failings as president — namely, 600,000 deaths from Covid-19 through a lack of leadership on his part.

“600,000 dead Americans could not be reached for comment,” wrote one user.

“Shouldn’t you be in jail?” asked another.
