NEW: A civil case can be conducted with as few as 6 jurors; in the E. Jean Carroll case, Judge Kaplan sat 9 people, giving himself and the parties a three-juror cushion. That the trial was canceled for today was 1) not a foregone conclusion; 2) at Trump’s lawyer’s urging. Why? 1/

Let’s start with the obvious: Alina Habba was exposed to COVID just days ago when she had dinner with her now-positive parents. And she’s symptomatic too. Although she tested negative this morning, she advised Carroll’s lawyers over the weekend that she was feverish. 2/

Especially given that she notified counsel over the weekend, there’s no reason to doubt her COVID-related representations. 3/

But Team Trump asked for a pause for another, more strategic reason. Indeed, they do not appear to be all that concerned about COVID; none of them wore masks, and Trump whispered to Habba, who was next to him, getting within inches of her face. 4/

Instead, I think Trump’s side likes their chances better with the sick juror than without him. Because this jury is anonymous and steps have been taken to protect them from harassment, I hesitate to publish even vague details about his age, education, occupation, etc. 5/

But it’s fair to say that at least on the surface, he doesn’t seem to be a limousine liberal. Still, as @PaulaReidCNN noted, they could have moved forward—and chose not to do so for their own reasons, which may or may not concern the juror. 6/
