Will Trump Get Gag Order In Manhattan DA Case? Here's What That Would Mean--And Why It Could Land Him

Former President Donald Trump is set to be arraigned Tuesday after he was indicted by the Manhattan district attorney’s office—and the court could impose a gag order that would cut him off from publicly discussing the case and impose legal consequences if he does, as the ex-president has already lashed out over his indictment and reportedly plans to ramp up his attacks.

Key Facts

A gag order is an order imposed by a judge in a criminal or civil case that blocks a party (including attorneys or witnesses) from publicly talking about the case, though the exact terms of the order and what can and cannot be said vary.

If a gag order is violated, the party could be held in contempt of court, which in New York carries a punishment of a $1,000 fine and/or up to 30 days in prison.

Legal experts cited by Insider and Bloomberg said it’s possible and even “extremely likely” the court could impose a gag order on Trump, particularly given security concerns arising from his attacks on prosecutors or other figures in the case, though there are First Amendment issues given that he’s running for president that could make any broad restrictions on his speech legally problematic.

Any gag order would likely be “narrowly tailored” to only cover certain kinds of information about the case, Katie Townsend, deputy executive director and legal director of the Reporters Committee for Freedom of the Press, told Bloomberg.

It’s most likely a gag order would be put on Trump when he’s arraigned Tuesday as a condition for his release from custody, former federal prosecutor Duncan Levin told Insider, and the former president’s attorneys could also be barred from publicly discussing the case so as to not taint the jury pool ahead of a trial.

The order would be issued by New York Supreme Court Justice Juan Merchan, the judge presiding over the case—an “absolutely no-nonsense judge,” according to Levin, whom Trump has already attacked on social media.

State prosecutors in Manhattan subpoenaed President Trump’s family business on Thursday, reviving an investigation into the company’s role in hush-money payments made during the 2016 presidential campaign, according to people briefed on the matter.

The subpoena, issued by the Manhattan district attorney’s office, demanded the Trump Organization provide documents related to money that had been used to buy the silence of Stormy Daniels, a pornographic film actress who said she had an affair with Mr. Trump.

The inquiry from the district attorney’s office, which is in early stages, is examining whether any senior executives at the company filed false business records about the hush money, which would be a state crime, the people said.


The investigation will focus on a $130,000 payment Michael D. Cohen, the president’s lawyer and fixer at the time, gave Ms. Daniels. Mr. Cohen also helped arrange for a tabloid media company to pay the Playboy model Karen McDougal, a second woman who said she had had an affair with the president. The disclosure of the payments ignited a scandal that threatened to derail the Trump presidency.


The Manhattan district attorney’s office on Thursday separately subpoenaed the media company, American Media Inc., the publisher of the National Enquirer.

The subpoenas from Cyrus R. Vance Jr., the Manhattan district attorney, came only weeks after the Trump Organization had appeared to fend off federal scrutiny of the same payments.

The United States attorney’s office in Manhattan, which charged Mr. Cohen last year with campaign finance violations in the hush-money case, revealed in a court filing last month that prosecutors had “effectively concluded” their inquiry, signaling that it was unlikely they would file additional charges.

But state law makes it a crime to falsify business records, offering the Manhattan district attorney’s office another avenue.


The district attorney’s office initially considered mounting the inquiry nearly a year ago, after Mr. Cohen pleaded guilty. Mr. Vance’s office paused at the request of the federal prosecutors.

Trump faces more than 30 counts related to business fraud, sources tell CNN

Former President Donald Trump faces more than 30 counts related to business fraud in an indictment from a Manhattan grand jury, according to two sources familiar with the case.

Earlier Thursday, a spokesperson for Manhattan District Attorney Alvin Bragg said the office has contacted Trump's attorney to "coordinate his surrender" for arraignment on "a Supreme Court indictment, which remains under seal."

"Guidance will be provided when the arraignment date is selected," it added.

Trump will likely appear in court early next week, his defense attorney said.

The survey found that AR-15 owners come from red, blue and purple states. Compared with Americans as a whole, AR-15 owners are significantly more likely to be White, male and between the ages 40 and 65. They’re also more likely to have higher incomes, to have served in the military and to be Republican. And AR-15 owners are more likely to live in states former president Donald Trump won in 2020 than adults overall.

Self-defense was the most popular reason for owning an AR-15. Other popular answers included recreation, target shooting and hunting, while some pointed to owning an AR-15 as their Second Amendment right.

Son: Dad, what was a "school shooting"?

Dad: Well son, it's difficult to explain why and how our grandparents let it happen. But sadly, for decades, mass shootings of young students were allowed to continue. Firearms were the No. 1 killer of people under 18 and I suppose, like a lotof things, it was just the way it was. Most people like you and I wanted something to be done, but the ruling minority, the Republicans, called it 'freedom and a right' as the gun manufacturers' lobby bought influence by paying off Republican lawmakers- (Interruption)

What's a Republi-can, dad?

Dad: Right, that was an old political party that claimed to be for expansive freedoms for all Americans but the reality was that the party was stifling and squelching freedom after freedom, civil right after civil right, even banning books that made them 'uncomfortable'. The party now only exists as a fringe party that is known as the Freedom Caucus party. The reality was that students and their teachers were slaughtered by 5's and 10's while simply attending school, hundreds every year. Year after year, the conservatives didn't seem to really mind as long as they got their lobbyist donations. The shootings were so common place that much of society became numb to the gun violence in schools.

Son: OMG! They actually sent us to be murdered by some crazy person with an army rifle?!

Dad: Ahem, let's see, in 2025, after Democratic were able to attain large enough majorities in both house of Congress, laws were created to prevent the ownership of weapons of war by the general public. It really does seem like madness. Cowardice, really.

Son: Ack! What were they all thinking?!

Dad: Oh, well, everyone was told that our leaders were extremely focused on fighting crime and foreign drug traffickers.

Son: Yah, I read about older generations using a LOT of drugs back then, but I've NEVER seen a book on this school shooting stuff, I thought it was all a rumor, you know, like the Bible.

Dad: Okay, time to go to sleep now son, sweet dreams Barack.

Members of a recently formed Russian assault unit say their commanders deployed troops to stop them from retreating and threatened them with death after they suffered “huge” losses in eastern Ukraine.

In a video addressed to President Vladimir Putin, a group of about two dozen men in military uniform say they are the remnants of Storm, a unit under the defence ministry.

“We sat under open mortar fire and artillery for 14 days,” Alexander Gorin, a Russian soldier, is heard saying in the appeal, which first appeared on Friday on Russian Telegram channels. “We took huge losses. Thirty-four people were injured and 22 died, including our commander.”

Another soldier said the unit initially comprised 161 men at the start of the operations.

Gorin said his men made the decision to head back to the Russian army headquarters but were denied evacuation by their superiors: “They placed barrier troops behind us and weren’t letting us leave our position … They are threatening to destroy us one by one and as a unit. They want to execute us as witnesses of a completely negligent criminal leadership.”
