And that, after the first mistrial motion was granted, the prosecutor had the option of simply handing over the evidence and then asking it be barred as irrelevant.

That the prosecutor did not do so indicates that, probably because we’re now under a Trump administration, there’s neither the political will nor courage to take on right wing lunatics (especially after they won in Oregon).

Caveat: this is all pure scuttlebutt and speculation from friends in the federal courthouse. Theoretically the judge is also super liberal.
