(5,350 posts)You may have interpreted his mere presence to be threatening, but considering that he just approached you, albeit in closer proximity than you would have liked, and started talking that's pretty much projection on your part. From what you said, he wasn't armed, he didn't actually touch you in any way and he didn't actually threaten you. So unless you can point to some law or ordinance that defines what your territorial "personal space" which cannot be invaded is, you wouldn't have any legal recourse in this situation. Therefore, you didn't have any more right to be where you were than he did and your reasonable choices would probably have been to decline to engage and either find another nice tree (preferred and least likely to result in escalation) or just ignore him.
