Notary Scholar: Questions About Notarization Put President Trumps Confidentiality Agreement With Stormy Daniels At Risk

I often field questions from journalists when Notaries and notarizations get into the news. That happened this week when media reports surfaced that the Texas Secretary of States office is investigating the Notary involved in the $130,000 confidentiality agreement allegedly entered into in 2016 between an adult film actress and then-presidential candidate Donald Trump.
The Notary faces possible revocation of her commission due to the apparent failure to complete notarial certificates for the two documents involved in this matter. The case also illustrates the problems that can occur when notarizations are not performed correctly.
In this case, there are a number of questions about the so-called notarizations and whether the agreement is invalid as a result of problems with them.

Texas investigating notary over failure to sign Stormy Daniels nondisclosure agreement: report

Officials in Texas are investigating the nondisclosure agreement signed by adult-film actress Stormy Daniels after it was revealed that the notary did not sign or date the document, the Dallas Morning News reported Monday.
Texas notaries are required to sign and date agreements, as well as provide a certificate verifying those who sign documents.
However, notary Erica Jackson is now facing an investigation after she failed to do all three for the 2016 nondisclosure agreement regarding Daniels's alleged affair with President Trump. Jacksons stamp is on the document.
Attaching your seal to a document without a notarial certificate constitutes good cause for the secretary of state to take action against your notary commission," a Texas official said in a letter to Jackson, sent last week.
