Hannity's tweet does not say either #1 or #2. Why his tweet would be #3 I have no idea. I don't listen to his show so I have no idea about either #4 or #5.

A lawyer does not have to "represent in a matter" someone or get "fees" to be their lawyer for legal advice. That advice is privileged.
