Is that the "question" about indicting a sitting President is predicated upon the notion that the "crime" was committed while he was President, not prior to taking office. This is an entirely different scenario, that the crime was committed prior to taking office. Further, the repayment was after he took office, which boxes them in to crimes before taking office and after.

Bottom line, there's no way out for Trump. They can seal indictments and have them waiting for him for when he is no longer President.
