Eon Productions owns the trademark and copyrights to the character, hence the potential changes Barbara Broccoli (producer of the current iteration) has been discussing openly with MGM.
And due to the spurious nature of trademark laws from country to country, the character is already in the the public domain in some countries.
Though I'm betting none of this will change your predisposition to a male-only actor for an imaginary role.
