When was he charged?
When was he tried?
When was he convicted?
When was he sentenced?

So far, it's only an allegation.
Fact is that no one on this board know whether or not he's guilty of this allegation.

There are proven facts of why he should not be confirmed, lying under oath is a pretty big one.
