The admissions to the counselor helped her case, but by not allowing those notes and records into evidence you are back tonhe said/she said.
The polygrapnexam, unfortunately, was done in such an unorthodox way that it isnt going to carry much weight. They had her write a statement and then just asked her is it was accurate- not a conventional polygraph exam process but one that appears to have been designed to be as easy to pass as possible. Granted if I was lawyer setting one up for my client I would want it as easy to pass as possible too, but the way they did it makes it easy to question.
So that leans in her favor, but in the end at best even a full polygraph would only show that she believed it to be true, you can be firm in a mistaken belief and pass.
Now they have 2 guys willing to take the fall for this and admit to sexual assault.
So he said, she said, he says no that was me situation.
You just cast HUGE doubt into it now. Huge. Like no way this could ever get prosecuted. Like this now gives cover to anyone voting for him. Because she can tell the most convincing story in the work to everyone and they can just say I dont doubt bad things happened to her but since another man is admitted it was him shes just mistaken about who it was.
This seals the deal- hes going on the court.
