He is giving testimony while under the influence. His judgement is impaired. His thought-process is impaired.

This is NOT the type of person that needs to be on the USSC. (I'm sure we've had alcoholic/drunk Justices before... but when we know about it in advance... as we do now... why would anyone risk it?)
