1. I think that if the conspiracy occurred in the US he could be charged with that.

To be guilty of conspiracy two or more people have to plan a crime and take some active step in furtherance of the crime. Seems to me that if Mr. Shmushner obtained and passed on information about the whereabouts of the victim to whomever arranged for the hit, that might qualify as an active step.
