If trump resigns and Pence is indicted, are we looking at President Pelosi, or did I miss a step? Hmmm...
There's a Justice Department policy against indicting a sitting President. As far as I know, there's no such policy for the Vice President, and the argument against indicting a President (that it would interfere with the performance of his duties) doesn't really apply to the Vice President.
I don't think there's a clear precedent, but Agnew probably would have been indicted if he hadn't reached a plea agreement and resigned.
Of course if Trump resigns before Pence is indicted, then Pence is no longer a sitting Vice President, and the Justice Department policy kicks in.
And indicting a Vice President doesn't remove him from office. If Pence is indicted and Trump resigns, Pence still becomes President.
