(1,313 posts)The concept of the court is bad - at least since Marbury v Madison - maybe originally.
This court acts as an unelected, unaccountable legislature.
It picks and chooses what it acts on - it doesn't have the capacity needed.
The time for judicial review is at the beginning of a law's life, not at some random time when long in place.
There are some libertarians who have developed these ideas. I've come to see a lot of wisdom in this critique.
Sometimes we have courts that support our ideas, and sometimes not. I think it is important to see that the concept is bad regardless.
I don't think it's ever solved any problems. It has temporarily stopped debate and maybe the benefit is stopping the bleeding or giving everybody a time out, but it doesn't do anything useful for our social ability to compromise. We've come to see it as a substitute. It's a bad one.
