If he withheld funds because he was concerned about corruption - then it wouldnt be impoundment. If he withheld it to pressure them to dig up dirt, then it could be impoundment... but it wouldnt matter because the deal is already impeachable.
IOW - claims that the withholding could be illegal under the 1974 law dont add to the case.
