(1,058 posts)There's absolutely no constitutional protection of hunting. It would be Constitutional for hunting to be outlawed in every state and on every piece of land owned by the federal government. Even if an individual state had some constitutional protection, the federal government could certainly use the same argument used by Wickard v Filburn to act nationally.
So what would be the relevance to a bunch of guys showing up with bird guns and hunting rifles?
The whole point of the second amendment related to the need for a civilian populace (with or without the supporting concept of a militia depending on how you choose to read the amendment) to kill PEOPLE, or at least to have the threat of killing people as a credible counter to other people who were armed.
