In reply to the discussion: What is the plan if Agolf Twitler loses in November and says he won't leave? [View all]Thunderbeast
(3,823 posts)58. Here is my fear...
My concern is that there ARE constitutuonal angles that can be played to nullify the vote. If the Senate hears and affirms a challenge by ONE house member to the validity of an election by questioning the rightful credentials of electors (as some Democrats in Congress attempted in 2000), the Senate CAN throw the challenged decision to the House of Representatives where EACH STATE GETS ONE VOTE. Each state's legislature can overturn their own voters' decision to cast their vote as they deem advantageous.
Just as prescident was ignored in the Merrick Garland nomination, many of us fear an end run to steal another election. The holy trinity of voter suppression, partisan Secretarys of State, and a widely viewed propaganda machine make all of this possible.
Trump would likely win this vote.
Who then will the military and Secret Service follow.
The Constitution assumes that the co-equal branches will check the power of the executive. It is all held together by an unwritten faith that no one branch will be allowed to usurp more power than intended by the founders.
The extraordinary power assumed by corporate America in their inflence on all three branches has distorted ALL of the assumptions made by Jefferson, Hamilton, Adams, and the other Constitution's authors.

OP
Keep in mind that our military takes an oath to protect and defend the Constitution, not the POTUS

I would hope it doesn't require that. But indeed someone may need to escort him out.

The big question is who will fumigate the White House when they leave.

I guess it all depends on whether or not the majority will hold true to their oath.

No man is above the law. When that POTUS is the domestic enemy, all bets are off.

I think it would be a combination of the Secret Service and the US Marshal's Service,

He loses power at 12:00 on January 20. If Biden is not sworn in, Speaker of the House becomes Pres.

I had not thought about that. you are entirely right. Any justice can administer the oath.
