If the papparazzi who took the shots trespassed on private property to get the photo, that's one thing. Quite another is whether the breasts could be seen from a public street. I wouldn't have an expectation of privacy if I were to open my curtains of my living room and display my nude body to the neighbors or passers by. The police wouldn't be committing a "search" for example, if they were able to see criminal activity on private property if it is in public view and then engaged in an arrest thereupon.
