He will face three choices if subpoenaed:

1: Refuse to testify, and become subject to imprisonment for contempt of court.

2: Testify honestly (as if!), and send one or more of his cronies up the river.

3: Lie like a carpet on the stand, and face perjury charges.

Sounds like a win-win situation to me.
