It appears to be a deliberate targeting of these protestors. The perp may well have ties to extremist organizations, he may admit that it was a premeditated attack when interrogated by the police, etc.

While it’s certainly possible they may not make a 1st degree charge, it is also extremely premature to say “you will never find a jury to agree it is 1st degree.”
