Presidents are immune from civil lawsuits arising from actions taken in their capacity as president (Nixon v. Fitzgerald). But Betsy DeVos can be the named defendant ( but not sued personally) in a lawsuit against the Department of Education if the agency violates the law, and there have been lawsuits against that agency. Sweet v. DeVos was a class action against the Department of Education relating to the agency's refusal to forgive student loans for predatory for-profit colleges.
