The officer initiated a physical confrontation with the victim. In the scuffle, the officer believed the victim was attempting to take his weapon and he needed to fire to prevent his weapon from falling into the victims hands.

Of course there will be no discussion of why an armed officer, with their weapon drawn, decides to get into a physical altercation.
