It was created by a Federalist Chief Justice and judges as a means of hobbling the newly elected Thomas Jefferson and his Democratic-Republican Party from enacting 'revolutionary' laws in the interests of small landowners as opposed to bankers and mercantile interests the Federalist administration of Adams had favored.

In short, that doctrine emerged in circumstances quite close to the situation McConnell and his minions are tempting to create today.
