because they are tort cases based on state law and that don't raise either Constitutional issues or claims arising under federal statutes (and they almost always settle before trial anyhow); the Supreme Court and the lower federal courts are courts of limited jurisdiction. So it would be easy for her to answer - truthfully - that she would not have to recuse herself from a case that would almost certainly not be heard by the Supreme Court in the first place.
