(24,948 posts)I know that the composition of the Court looks bad but I wonder if Roberts and maybe Gorsuch may be persuadable? Killing the ACA in the midst of a global pandemic seems like it would be utterly suicidal, both politically and judicially. I hope that Roberts tries to find some way to convince at least one other member of the Republican wing of the Court to figure out a way to let it stand. It really sucks that this argument- which even some Republicans feel is specious- has made it this far. I don't think that it is particularly fair that this challenge was pretty much only teed up as a result of the Republicans killing the individual mandate. At the very least, if we are able to win the Senate with the Georgia races in January, if the Court does kill the law, maybe we could use reconciliation to at least apply a fix to it that would make it "Constitutional" again? It was fine until the mandate was stripped, right?
