5. why couldn't he? Georgia law allows the governor to appoint someone to fill a vacancy.

From January 3 until the winner of the Jan 5 election is sworn in, there's a vacancy. If, heaven forbid, Kemp looks to be the winner, there's absolutely no risk to Kemp for appointing him to serve until he's sworn in.
