And a website that takes precautions is going to be looked upon more favorably than one that doesn't. As I have said, it's part of (but not exclusively) an overall strategy to mitigate liability.
And I totally disagree with you on the scope of DU's ToS. There are at least two that are directly relevant to factual assertions in DU's TOS: No kooky, extremist, or hate content and Don't post anything that violates U.S. law. I've been on juries or MIRT where the factual correctness was at issue under either of those categories.
For example, if I posted "Senator X murdered Baby G and ate her", I'd be pretty sure that the DU jury, possibly MIRT , and/or the Admins would have that post deleted in a matter of minutes or seconds under the "no kooky" category. No need to get lawyers involved. And it shows that DU has a responsible system in place to flag flagrant issues like my example.
