(7,715 posts)Online companies, big and small, already have to comply with data privacy requirements in the US and around the world. And it wouldn't necessarily result in litigation absent a failure to remove the defamatory post.
Of course, it would require creating a regulator. But, the Federal Trade Commission and the individual states have consumer protection powers. We'll like have data privacy regulators here too.
Let me give you an example. These days, I am learning not to trust reviews on Amazon etc. Apparently, some unscrupulous third-party vendors engage in something called "brushing" that allows them to post fake reviews on Amazon. If Amazon does not watch over this practice (i.e., fake comments posted by third-parties), I would be pretty sure that the feds and/or the state AGs could go after Amazon for allowing this practice to continue. That's not really different than an online site having liability and a duty to cure for defamatory statements.
