You mean... apart from it being illegal?

The "former guy" made lots of "acting" selections, but that doesn't mean that he had the ability to just pick whoever he wanted.

Tanden has not been senate confirmed for some other post and is not currently the first assistant for the previous OMB head, nor was she a senior officer in OMB for 90 of the 365 days preceding the vacancy.

She is therefore not eligible to fill the role as an acting head.
